Impacto de la Ley de Desindexación en el Tercer Sector

The Third Sector Platform, representing about 28,000 social entities, has called on the Government for the «urgent reform» of the Deindexation Law «due to its serious impact on the sustainability of social organizations.» This was conveyed by the Vice President of Political Incidence, Civil Dialogue, and Public Affairs of the Third Sector Platform, Luis Cayo Pérez Bueno, to the Director General of Economic Policy at the Ministry of Economy, Trade, and Business, Víctor Ausín Rodríguez.

According to the Platform, the Deindexation Law limits the price revision in contracts with the Public Administration for the provision of services, so social organizations with contracts with the Public Administration must provide services without price variation throughout the duration of the contract. «This law was approved with the aim of making the Spanish economy more competitive, but in the current economic context, it is seriously harming social entities because it creates an economic imbalance between the parties,» they assert.

Therefore, during the meeting, Pérez Bueno explained the need to eliminate the deindexation of public contracts and agreements in the field of social services carried out with Third Sector entities, because «high levels of inflation are detrimental to organizations.» In this sense, he explained that it is «essential» to legally regulate the viability of periodically reviewing the unit costs of services, in unforeseen situations not contemplated at the beginning of the contracting or agreement of the service, «for reasons of social interest.»

Furthermore, the Third Sector Platform demands the implementation of mechanisms that guarantee the economic stability of social entities and do not negatively impact their sustainability. The meeting also included the participation of the Executive Director of the Third Sector Platform, María José Juanes; the legal advisor of CERMI, Óscar del Moral, the Deputy Director General of Sectorial Analysis, Manuel Delacampagne, and the Deputy Director General of Social Policies, María Sobrino.
