The 35-year prison sentence imposed by the Barcelona Court on a young man for raping and attempting to murder a 16-year-old girl in Igualada (Barcelona) during the early hours of November 1, 2021, is now final
In an order accessed by Europa Press, the Criminal Appeal Section of the Civil and Criminal Chamber of the Superior Court of Justice of Catalonia (TSJC) reports that «the legal term has elapsed without any appeal being filed against it,» so the sentence is declared final and the case is returned to the Barcelona Court for execution.
This decision was made after this same section confirmed «fully» on January 28 the sentence of Section 10 of the Barcelona Court, rejecting the appeal filed by the defendant’s defense, who argued that he had acted under the influence of alcohol, suffered from chronic addiction, and had a «severe mental disorder.»
The court argued that it has not been proven that at the time of the events, his intellectual and volitional capacities were affected due to previous alcohol consumption, nor that he suffered a psychological disorder as a result of prolonged alcohol consumption; nor did he suffer a serious alteration or pathology affecting his capacities.
It concluded that «evil is defined as the quality of being bad or an evil or unjust action, so we are in the realm of human freedom, choosing between doing good or evil,» and that this evil does not fit into psychiatry nor can it be cured with drugs, literally.
