The minister of Inclusion, Social Security, and Immigration, Elma Saiz, has explained that the new immigration regulation, which will come into effect on May 20th, establishes an additional transitional pathway regarding the situation that some asylum seekers may find themselves in if their request is rejected.
«Those who receive a denial of asylum can apply for residency within six months, a much shorter period than what is required for other applicants in this category. This formula provides a more favorable regulation for those who have been denied international protection and, at the same time, respects the legal framework in our country that we are obliged to comply with,» she stated.
Saiz made these remarks on Tuesday during her speech in the Senate, when asked by EH Bildu senator Olaia Duarte about the government’s response to the potential negative impact on the rights of asylum seekers when the new immigration regulation comes into force.
She emphasized that they will continue to work, monitoring the various scenarios that may arise to assess all the tools that can be deployed to provide a response to individuals in Spain «with legal certainty and security within the regulatory framework.»
In this context, she recalled the procedure approved by the Council of Ministers last February, which granted extensions and renewals of authorizations.
«I assure you that we will continue to work to ensure that migration remains a valuable example of personal decision-making to overcome adversities and achieve a better life. Fortunately, more and more people understand that governments can help migrants, their countries of origin, and the society that welcomes them,» Saiz pointed out.
According to the minister of Inclusion, Social Security, and Immigration, the new immigration regulation «is a crucial lever» to address the demographic challenge and social and economic progress in Spain, and «a bold commitment to strengthen the rights of immigrants» in the country.
She added that this regulation sends a «very clear message» to those who want to come to Spain to do so through regular, organized, and safe channels, while also addressing the needs of those already here through three fundamental pillars: Work, family, and education.
«In contrast to the competition in the right-wing and far-right parties to see who is more radical and intolerant towards immigrants, this government defends a migration model based on human rights,» the minister concluded.
