The magistrate of the Court of Instruction number 3 in Oviedo has issued this Thursday, in agreement with the Public Prosecutor’s Office, a provisional release order with the obligation to appear every 15 days in judicial facilities for the man arrested after the discovery of his mother’s body in his home in the La Corredoria neighborhood of Oviedo. He has invoked his constitutional right not to testify.
Initially, the proceedings have begun for a homicide offense, yet to determine whether it is negligent or intentional pending the final autopsy reports; an animal abuse offense, and a social security offense related to the possible collection of pensions from his deceased mother.
Therefore, the Public Prosecutor’s Office requested his provisional release during the instruction of the procedure, during which any potential offenses attributable to the detainee will be clarified. All of this, without prejudice to any developments that may arise from the investigation of the case.
The police intervention began on March 7 after receiving a call to 091 alerting of strong odors coming from inside a residence. A patrol arrived at the scene, but the man, who may have a mental illness, did not allow the agents to enter the home.
Consequently, the police requested a judicial search warrant, which was executed last Monday, March 10, at 7:00 p.m. Upon entering the residence, the agents found the woman’s mummified body among the trash.
The body was surrounded by a «large number» of animals in the home, which were transferred to the Oviedo Animal Shelter.
